Thanks Norma Lee, for providing the link to Sacramento County Court documents. As a country bumpkin, I wasn't aware that such complete records were available online, and almost immediately.
If you would like to see the sequence of documents filed relating to the proposed Walmart at Bruceville and Whitelock, you can go to CCMS Online Document Viewing and enter the year (2009) and case number (80000332). Some of the material is even readable to non lawyers, including the meat of the issue, the petition for a writ of mandate.
Some highlights from the writ:
...the City did not conduct any environmental review for the Land Use Approvals, hold public hearings for the Land Use Approvals, provide any notice of the Land Use Approvals, or otherwise provide an opportunity for Petitioner or other members of the public to raise objections to the Land Use Approvals...
The City prejudicially abused its discretion and acted in excess of its jurisdiction by approving the Project without first requiring a CUP for the "Retail Discount Superstore" use and preparing the studies required to analyze the potentially significant impacts of the "Retail Discount Superstore" use, including a Community Impact Analysis, an Economic/Fiscal Impact Analysis, a Crime Analysis, and an Urban Decay Analysis for the Project.
The writ asks (prays) for the court:
For a preliminary restraining order and preliminary and permanent injunctive or stay relief restraining the City and Real Party in Interest from taking any action to carry out the Project pending the outcome of this litigation...
