Walmart Lawsuit to go forward
It came to our attention in a Sacramento Bee article that Elk Grove was being sued over the Walmart Store. The article identified the plantiff as "Friends of Madiera" residents of Del Webb Glenbrooke.
The suit was filed in September, stating the city violated land use and environmental laws when it approved the Walmart last spring. The city and Walmart reponded the residents waited too long to sue. If the the judge agreed today, he could throw out the lawsuit.
However, the motion, heard today in Department 33 of Superior Court, was overruled - paving the way to go forward to trial. The clerk of Dept 33 confirmed the overruling and said a hearing date has not been set but most likely would be April or May.

According to an article written today in the Sacramento Bee, Elk Grove has been sued over the Walmart store. The city says that the plaintiff missed the filing deadline. If the judge agrees at a hearing Friday, he could throw out the lawsuit.
Elk Grove is supporting Wal-Mart Stores Inc. in fighting a citizen lawsuit against a new Walmart in the city's south end.
A group called Friends of Madeira sued the city in September, complaining that the city violated land use and environmental laws when it approved a nearly 100,000-square-foot Walmart store in the retail center last March.

Yes, Norma this is the information from the Sacramento Bee, which identified the group as residents of Del Webb Glenbrooke neighborhood. I would love to hear 'the other side" if any of the residents would like to leave their comments or call me at 647-6594 and I will post them.
I don't think that info will be forthcoming Darcie, or we would have had some prior notification from the residents. Info I have..??if true....is that it will only be a reading of the judges ruling, arguments were presented in advance. JM, but I wish them Good Luck. Guess we'll know tomorrow sometime.
Had to take a Squeeze In break......it appears the ruling is tomorrow afternoon. Any other info will have to be from the parties involved, newspapers, etc. GOOD LUCK from this household!!
